About these terms
These terms and conditions ("Terms") govern your use of elitetraders.io (the "Site"), the free EliteTraders Discord and the EliteTraders VIP membership (together, the "Services"). The Services are provided by EliteTraders LLC, a limited liability company registered in New Mexico, USA ("EliteTraders", "we", "us").
If you do not agree to these Terms, please do not use the Services.
Eligibility
You must be at least 18 years old, and legally able to enter into a contract where you live, to use the Services. By using them you confirm that you meet these requirements.
You are responsible for making sure that trading the markets discussed in the Services is legal where you live.
Not financial advice
Everything provided through the Services is general education and market commentary. It is not financial, investment, tax or legal advice, and it is not a recommendation to buy or sell any financial instrument.
EliteTraders LLC is not a registered investment adviser, broker-dealer or financial adviser in any jurisdiction. Trade ideas, signals, analysis, webinars and any other content do not take into account your personal circumstances, objectives, financial situation or risk tolerance.
You are solely responsible for your trading decisions, including whether to act on any content, the size of any position and how you manage risk. You should consider seeking advice from an independent, suitably qualified professional before making any financial decision.
Trading risk
Trading foreign exchange, contracts for difference, futures, commodities and indices, particularly on margin, carries a high level of risk and may not be suitable for everyone. You could lose some or all of your capital, and in some cases more than your initial deposit. Past performance, including any trades, results or reviews shown on the Site or in the Discord, does not guarantee future results. Please read our Risk Disclosure in full.
Memberships and billing
The free Discord is available at no cost. VIP membership is a paid subscription, currently offered on monthly, quarterly and yearly billing periods at the prices shown on the Site at the time of purchase.
Payments are processed by Whop, a third-party platform. By purchasing a membership you also agree to Whop's own terms and privacy policy. We do not receive or store your full card details.
Some plans, such as the monthly plan, may start with a free trial. If you do not cancel before the trial ends, your membership starts automatically and you are charged the price shown at checkout. Taxes may be added at checkout depending on where you live.
Memberships renew automatically at the end of each billing period at the then-current price for your plan until you cancel. We may change prices for future billing periods, and will give you reasonable notice before a price change affects an existing membership.
Cancellation and refunds
You can cancel at any time from your Whop dashboard. Cancelling stops future renewals, and you keep access until the end of the billing period you have already paid for. Refunds are covered by our Refund Policy, which forms part of these Terms.
Your account and access
Access to the VIP Discord is personal to you. You must not share your login, invite others into private channels, or allow anyone else to use your access.
You are responsible for keeping your Whop and Discord accounts secure and for all activity that takes place through them.
Community rules
To keep the community useful for everyone, you agree not to:
- copy, record, screenshot, resell, republish or redistribute signals, analysis, research or any other members-only content outside the VIP Discord
- harass, abuse, threaten or discriminate against other members or staff
- promote other services, spam, or send unsolicited messages to members
- post misleading information, impersonate others or claim to speak for EliteTraders
- use bots, scrapers or other automated tools to collect content from the Services
- use the Services for anything unlawful
We may remove content, and suspend or end access, for anyone who breaks these rules. Where access is ended for a serious or repeated breach, no refund will be due for the remaining billing period.
Intellectual property
The Site and the content we create for the Services, including trade ideas, written analysis, reports, webinars, videos, graphics, the EliteTraders name and logo, are owned by or licensed to EliteTraders LLC and are protected by intellectual property laws.
While you are a member, you may view and use that content for your own personal, non-commercial use only.
Some materials discussed in the Services, such as third-party research, data, charts or news, belong to their respective owners. Where we reference or summarise them, we do so for commentary and education, and all rights remain with those owners.
Third-party services
The Services rely on third-party platforms, including Whop for payments and access, Discord for the community and Vimeo for video. Their availability is outside our control and your use of them is governed by their own terms. Links to other websites, including WatchTower Terminal, are provided for convenience and are covered by those websites' own terms.
Availability and changes
We aim to keep the Services running smoothly but cannot guarantee they will always be available, uninterrupted or error-free. We may change, add or remove features, channels or content from time to time. The number, timing and outcome of signals are never guaranteed.
Limitation of liability
To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis, and EliteTraders LLC, its members, managers, staff and contributors will not be liable for any trading losses, lost profits, or any indirect, incidental, special or consequential loss arising from your use of, or reliance on, the Services.
To the fullest extent permitted by law, our total liability to you for any claim relating to the Services is limited to the amount you paid us for the Services in the three months before the claim arose.
Nothing in these Terms limits any liability that cannot be limited under applicable law, or any statutory rights you have as a consumer.
Indemnity
You agree to indemnify EliteTraders LLC against any claims, losses or costs arising from your breach of these Terms or your misuse of the Services.
Changes to these Terms
We may update these Terms from time to time. The latest version will always be on this page with the date it was last updated. If a change materially affects paying members, we will give reasonable notice. Continuing to use the Services after a change takes effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of New Mexico, USA. If you are a consumer living elsewhere, you may also benefit from mandatory consumer protection laws of your country of residence, and nothing in these Terms affects those rights.
